Definitions

“Seller/we/our/us/Holika Holika” means Nordic Beauty OÜ, Roosi 26, 51009, Tartu, Estonia, (registered in Estonia, company registration no. 11630158) and the company's website www.holikaholika.ee

“Customer” means the person or company to whom this document is addressed.

“International Customer” shall mean, “Customer” from outside the Estonia.

“International Delivery Destination” shall mean delivery location outside Estonia.

“Website” shall mean, www.holikaholika.ee or any other subdomains of holikaholika.ee which may be accessible unless expressly excluded by their own terms and conditions.

“Order” shall mean the submission of an order for products on the “Website” by the “Customer”

Validity of terms and conditions of sale

The terms and conditions of sale shall apply to the rights and obligations arising between the customers of Holika Holika online store (hereafter referred to as Customer) and Nordic Beauty OÜ (hereafter referred to as Holika Holika) with the purchase of goods.

In addition to these terms and conditions, the legal relationships arising from the purchase of products from Holika Holika online store shall be regulated by the legislation applicable in the Republic of Estonia.

Holika Holika shall reserve the right to change the terms and conditions of sale and the prices. These changes will be displayed on Holika Holika’s web page.

Price information

All prices at Holika Holika online store include a value added tax (VAT) of 22%.

Discount percentages displayed are rounded off to full figures.

Prices for our goods may change from time to time, but changes will not affect any order which we have confirmed.

All prices are quoted in Euros and include VAT (where applicable) at the applicable current rate chargeable in the Estonia for the time being. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the products in full before the change in VAT takes effect.

The Website contains a large number of products. It is always possible that, despite our reasonable efforts, some of the products on the Website may be incorrectly priced. If we discover an error in the price of the products you have ordered we will inform you of this error and we will give you the option of continuing to purchase the product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the products to you at the incorrect (lower) price.

Payment

Payments must be made in Euros only, unless otherwise specified, and by one of the following payment methods: PayPal, credit card, banklink or invoice.

Major credit cards as listed: Visa, MasterCard, Maestro, AMEX, and Discover.

Any discount codes issued are strictly subject to the individual terms and conditions with which they were issued, which may include, amongst other things, eligibility of use and maximum order value. If any of the terms and conditions with which the discount codes were issued contradicts these terms and conditions, the terms and conditions in respect of the discount code will prevail. We reserve the right to reject or cancel any orders which do not comply with these terms even if your credit or debit card has been charged.

Entry into force of the contract of sale

The consumer undertakes to pay for the order after clicking „Complete order“.

The contract of sale shall enter into force after the receipt of the payment made by Customer on the bank account of Nordic Beauty OÜ.

Delivery

After the entry into force of the contract of sale (after the receipt of the payment made by Customer), Holika Holika will assemble the order and hand it over to the company's logistics partners for delivery.

Any date or period for delivery shall be considered as indicative only, although it is our policy to try to despatch all orders within 3 working days. Any products not available at the time of your order will be sent to you, as soon as possible, when received from the supplier.

In order to avoid delays in delivery, the order forms have to be filled in carefully and the delivery information submitted should be accurate and valid.

Products damaged (but not its packaging) during transportation shall be replaced to Customer. Should the replacement be impossible, Customer shall receive a refund equal to the price of the products.

Holika Holika shall not be held responsible for a delay in delivery if the goods were handed over to the logistics partners on time, but the delivery was delayed due to circumstances that Holika Holika could not foresee or control.

If you order goods from the Holika Holika online store for delivery to one of the International Delivery Destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount.

You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.

You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable or responsible if you break any such law.

Return policy

Items purchased through Holika Holika online store may be returned within 14 days of the date of the receipt. Should Customer find the purchased item unsuitable, s/he can return it to the online store without indicating the cause for return.

If Customer wishes to return purchased items, please contact customer support at info@holikaholika.ee.

Purchased items must be returned immediately, but no later than within 14 days following the submission of the request for withdrawal.

The right to withdraw shall cover items that are unused and the package intact and undamaged.

Should it become inevitable that Customer has to pay the return costs, the online store shall refund the cost of purchased items and return costs no later than within 14 days following the receipt of the request for withdrawal.

The withdrawal period of 14 days shall not apply to the following items:

  1. items produced in accordance with Customer's personal needs;

  2. items produced custom-made according to conditions set out by Customer;

  3. items unsuitable for return due to health protection and hygiene reasons or if their packaging is removed after delivery;

  4. items mixed or diluted with some other product or items, so that they can no longer be separated from each other;

  5. items used for business and professional activity purposes;

  6. breakdown or failure resulting from improper use of the appliance (failure to follow instructions for use);

  7. appliance that had been plugged in wrong voltage;

  8. broken items or items with mechanical damage (e.g. after falling);

  9. in the event of ordinary wear and tear or in the event of faults which do not cause the appliance's depreciation of value nor impair its use;

  10. the appliance has undergone repairs by a technician/repair center not authorized by the manufacturer.

If Customer does not receive the items he had ordered, or the items delivered do not correspond to the description provided on the web page, or items appear defective, Customer may, instead of filing a request for withdrawal within 14 days of receipt, use his/her right to present a complaint arising from the law.

The use of the purchased items/goods for business or professional activity purposes (incl. legal persons)

In the event where purchased items have been used for business or professional activity purposes or have been purchased by a legal person, the ordinary complaints procedure shall not apply. In these cases, the period for filing a complaint is usually 6 months or over – depending on the time limits set by the manufacturer. During this period, if the manufacturer's defect had been detected, the item will be replaced or will undergo a repair.

The items shall not be subject to return if:

  1. items are produced in accordance with Customer's personal needs;

  2. items are produced custom-made according to conditions set out by Customer;

  3. items are unsuitable for return due to health protection and hygiene reasons or if their packaging is removed after delivery (cosmetics etc);

  4. items are mixed or diluted with some other product or items, so that they can no longer be separated from each other;

  5. items are used for business and professional activity purposes;

  6. items have a failure resulting from improper use (failure to follow instructions for use);

  7. appliance was plugged in wrong voltage;

  8. items have mechanical damage or are broken (e.g. after falling);

  9. in the event of ordinary wear and tear or in the event of faults which do not cause the appliance's depreciation of value nor impair its use;

  10. the appliance has undergone repairs by a technician/repair center not authorized by the manufacturer.

Liability

Should We or Customer breach the present terms and cause damage to the other party, the breaching party shall be liable to the non-breaching party in the events and to the extent provided for in the legislation of the Republic of Estonia.

Force majeure

Holika Holika shall not be held liable for the damage caused or for delivery delays, if the damage or delay is caused due to circumstances Holika Holika could not foresee or control.

Processing of personal data

The information and personal data collected when visiting Holika Holika online store and during the processing of orders shall be treated as confidential and shall not be disclosed to third parties.

Encrypted communication with banks during the payment of goods ensures the security of Customer's personal bank details.

Complaints procedure

Holika Holika shall be held liable for the non-compliance or defects of the goods sold to Customer that occur within two years from the receipt of these goods by Customer.

Should goods be found non-compliant or have defects, please send the complaint to info@holikaholika.ee.

The complaint should contain the following information:

  • Customer's name and contact details;

  • Date of presenting a complaint;

  • Description of the product's defects;

  • Complaint being presented to Holika Holika;

  • Reference to documents, confirming the fact of the transaction or a warranty, or provide their copies in the attachment.

Holika Holika will reply to a complaint in writing within 15 days as of the receipt of the complaint from Customer. If Holika Holika is unable to provide a response to the Customer's complaint within 15 days, Holika Holika will inform Customer of that in writing, stating the reason for delay and the date by which the response will be provided.

Holika Holika shall not assume liability for defects that have resulted through the Consumer's fault, either due to improper storage or non-intended use of products. Defects are product defects, not defects of packaging.

Should the goods appear to be non-compliant to the contract's terms and conditions, or have defects or malfunctions, Customer shall have the right to demand the repair or replacement of the goods. If the repair or replacement is impossible, or proves unsuccessful, or causes Customer unreasonable inconvenience, Customer shall retain the right to withdraw from the contract and claim the return of money.

Privacy Policy

Any information passed through to Holika Holika is passed through a secure connection on the internet using Secure Socket Layer technology at 256bit encryption (where browsers will allow). If a customer wishes for their information to be removed from our database, this should be requested in writing to info@holikaholika.ee

  • We may collect and process the following data about you:

  • Information that you provide by filling in forms on the Website. This includes information provided at the time of registering to use the Website and purchasing goods.

  • If you contact us, we may keep a record of that correspondence.

  • Details of transactions you carry out through the Website and of the fulfilment of your orders.

  • Details of your visits to the Website.

  • We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users' browsing actions and patterns, and does not identify any individual.

  • We use information held about you in the following ways:

  • To ensure that content from the Website is presented in the most effective manner for you and for your computer.

  • To provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes.

  • To carry out our obligations arising from any contracts entered into between you and us.

  • To allow you to participate in interactive features of our service, when you choose to do so.

  • To notify you about changes to our service.

  • We may also use your data, or permit selected third parties to use your data, to provide you with information about goods and services which may be of interest to you and we or they may contact you about these.

  • The Website uses cookies to distinguish you from other users of the Website. This helps us to provide you with a good experience when you browse the Website and also allows us to improve the Website.

  • Please note, credit card details are not retained online. The only information stored is a customer's transaction history, name, address & e-mail address.

  • By submitting your email address in connection with the order/purchase process, you agree that we may use your email address to contact you for matters regarding your order and other promotional activity. If you wish to cancel your subscription to Holika Holika mailings, you can do so at any time by scrolling to the bottom of the email and clicking on the unsubscribe link. Alternatively, email info@holikaholika.ee with a request to be removed.

Intellectual Property

  • The Customer shall respect all licence agreements delivered by the copyright owners. Holika Holika cannot be held responsible or liable for any misuses conducted by the Customer or any third party.

  • All trademarks shown on www.holikaholika.ee belong to their registered owners and must not be copied without prior permission.

  • You must not use any part of the materials on the Website for commercial purposes without obtaining a licence to do so from us or our licensors.

Reviews

  • Whenever you submit a review or make use of another feature that allows you to upload material to the Website, or to make contact with other users of the Website, you warrant that you will be accurate and that you will not submit content that is unlawful or otherwise objectionable. This includes, but is not limited to, content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist. You warrant that any such contribution complies with those standards and that you own or otherwise control all of the rights to the content that you post, and you indemnify us for any breach of these warranties.

  • Any material you upload to the Website will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.

  • We have the right to use the name that you submit in connection with such content and to disclose your identity to any third party who is claiming that any material posted or uploaded by you to the Website constitutes a violation of their intellectual property rights, or of their right to privacy.

  • We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the Website.

  • We have the right to remove any material or posting you make on the Website if, in our opinion, such material does not comply with the content standards set out above.

Changes to Terms & Conditions

We reserve the right to change these terms and conditions at any time without prior notice.

Law

These terms and conditions are governed and shall be interpreted in accordance with Estonian Law. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.
